Mawoo Pets Health Guarantee Agreement

Overview

Welcome to the Mawoo Pets Health Guarantee, offered by Mawoo Pets Ltd. and Mawoo Pets LLC (collectively, “Mawoo Pets”, “we”, “our” and “us”). These terms govern all health guarantees (“Health Guarantee”) provided to customers (“Customer”, “Buyer”, “Purchaser”, “you”) for any puppy purchased from a breeder (“Breeder”) on Mawoo Pets. 

Your puppy’s health and well-being are most important to us. Before your puppy leaves the Breeder’s premises, he or she will be medically checked and cleared by a certified veterinarian. Additionally, your puppy will arrive home up to date on vaccinations and deworming schedule. While we do everything in our power to ensure that your puppy arrives home happy and healthy, unexpected circumstances can arise that challenge your dog’s health. We have developed this Health Guarantee to support you in such circumstances.

By purchasing a puppy on Mawoo Pets, you accept, without limitation, all of the terms indicated herein. These Terms are in effect as of the date of acceptance as noted above. We reserve the right to add, remove, modify or otherwise change any part of these Terms at any time without prior notice. 

Definitions

For the purpose of this Agreement, the terms mentioned below shall have the respective meanings:

  • Veterinarian (Vet): A licensed medical professional who practices veterinary medicine.
  • Breeder: The person who bred and sold you the puppy.
  • Buyer: You, the person who purchased the puppy.
  • Purchase Price: The cost of the puppy excluding taxes, shipping, health certificates, or any additional expenses.
  • Replacement Puppy: A new puppy of the same breed and equal value provided by the Breeder. Assumes the Breeder is still breeding the identical breed. Original puppy must be returned to the Breeder, and the Breeder is responsible for all return shipping costs. 
  • Liable Party: The party responsible for monetary claims arising from this Agreement.
  • Veterinary Hospital: All facility types and/or means by which a Pet receives veterinary care. Includes but is not limited to: veterinary teaching Hospital, veterinary Hospital, veterinary clinic, veterinary care center, veterinary specialty center, and mobile and/or house call veterinary practice. 
  • Pet Insurance: Policy that helps cover the cost of veterinary care for your pet.
  • Pet Insurance Deductible: The part of the vet bill that you have to pay before your pet insurance starts to cover the cost.

Buyer's Obligations

For you to be eligible for any Health Guarantee offered by Mawoo Pets, you are obligated to fulfill the below obligations

  • Delivery & Pickup Confirmation: Upon receipt of your puppy, you will be required to sign a form confirming receipt of your puppy and transfer of puppy ownership to you. 
  • Regular Veterinary Care: Upon arrival of your puppy, you must take your puppy in for a wellness/baseline exam by a licensed veterinarian within the first three (3) calendar days (72 hours). Ensure your puppy receives timely wellness check-ups and vaccinations.
  • Proper Diet: Feed the puppy food as recommended by your vet.
    Adequate Exercise: Provide sufficient physical activity for your puppy without overexertion.
  • Regular Health Check-ups: Monitor your puppy's health and promptly report any health issues.
  • Preventing Parvo: Your puppy has had a vaccination for Parvo, but it can still get this disease. To avoid this, don't take your puppy to places where unvaccinated dogs might have been until 2 weeks after its 4-month booster shot.
  • Spaying/Neutering: If your puppy is expected to weigh less than 45 lbs when it's grown up, it's recommended to have it spayed or neutered before it's 9 months old. If it's expected to weigh more than 45 lbs, then it should be done before it's 12 months old. For large breed male dogs, neutering between 12 and 18 months of age can help prevent prostate cancer. Spaying a female puppy can help prevent uterine infections and breast tumors, and neutering a male puppy can prevent testicular cancer and some prostate problems.
  • Rehoming: If for any reason you are unable to continue caring for your puppy, you have an obligation to ensure that it is rehomed responsibly. This means finding a safe and loving home, or working with a reputable rescue organization to facilitate the rehoming process. Never abandon the puppy or give it to a shelter without exploring all possible rehoming options first.
  • Release of Records: In order to process any claims, it is your responsibility to fully cooperate with us by providing all necessary documents and authorizing the release of any veterinary records pertaining to your puppy. This includes all examination notes, lab test results, and diagnostic reports. You agree to authorize a full release of any necessary records or information to Mawoo Pets LLC, for us to accurately assess and manage your claim.

What Is Covered?

The only Guarantee offered by Mawoo Pets is a 14-Day Health Guarantee that is designed to protect you and your puppy against certain health conditions. Coverage in these Health Guarantees does not apply to any Breed Specific Health Ailments and to conditions that are not covered as part of this Health Guarantee outlined below.

A puppy may be additionally covered by a Supplemental Breeder Health Guarantee. Any such coverage is not related to Mawoo Pets and is directly between the Customer and the Breeder. Please consult the Breeder’s Guarantee for details on the coverage, terms, and limitations of any such guarantee.


14-Day Health Guarantee
This Health Guarantee is included with every puppy we sell. Here's what it covers:
If a licensed vet finds your puppy has a contagious disease, an infection, or a life-threatening illness in the first 14 days after you get them, we'll cover the reasonable and documented cost of medical treatment up to the purchase price of your puppy.
We'll also cover the reasonable and documented cost of medicine if a Fecal Float Exam finds parasites in your puppy.
If two licensed vets say that your puppy has a hereditary or congenital (born with it) disorder that stops them from living a normal life, you are eligible for the option to receive a replacement puppy.

Supplemental Breeder Health Guarantee
This is an extra level of protection that some puppies come with, depending on the Breeder. Typically, it covers genetic and/or congenital conditions for a more extended duration (e.g., 30 days, 1 year, or 3 years). The breeder’s health guarantee terms should be referenced for terms and coverage.

What Is Not Covered?

The following costs and conditions are not covered in this Health Guarantee: 

  • What you pay for pet insurance, like your deductible and the percentage not covered by your insurance.
  • Cost of regular veterinary care, food, medicine, supplements, training, grooming, cleaning, or other costs of raising and owning a puppy.
  • Injuries or accidents, including, but not limited to, ingestion of foreign matters, choking, falls, scrapes, bumps, bruises, bug bites, human inflicted injuries, run-aways, car related injuries, injuries, and illness or injury resulting from or related to veterinary procedures (e.g. spay or neuter procedures, tail docking, etc.).
  • Behavior, personality, or temperament traits including, but not limited to potty training, chewing, digging, etc.
  • Appearance, size, or other physical characteristics, breed standards, or aesthetic preferences.
  • Hip dysplasia diagnosis in breeds that are known to be prone to hip dysplasia and are overweight or over exercised.
  • Results of genetic testing.
  • Contagious illnesses or parasites that are diagnosed more than 14 days after puppy's arrival.
    Hereditary diseases diagnosed more than 10 years after puppy's arrival.
  • Any health claims diagnosed more than one year after puppy's arrival if puppy is an English Bulldog.
  • Any of the following conditions diagnosed at any time in an English Bulldog: Cherry Eye, Entropion, "loose hips", skin allergies, elongated soft palate, small trachea, stenotic nares, and other normal conditions for English Bulldogs.
  • Coverage is limited only to puppy on invoice and excludes any other animals residing in or visiting to customer’s household.

Hypoglycemia is also not covered
All puppies, and especially small breed puppies 5lbs or under, are susceptible to hypoglycemia.  Also known as low blood sugar, hypoglycemia is characterized by: 

  • Low energy 
  • Little to no appetite 
  • Lethargy 
  • Overly hot – or cold – body temperature 
  • Vomiting and/or diarrhea 

To avoid hypoglycemia, it is important to make sure the puppy is on a proper- and monitored - feeding schedule. Especially during the first two weeks in a new home. A change in environment is a form of stress to a puppy new in a home, and this can be seen in improper eating. Always keep food available during the first couple weeks at home until the puppy is observed to be eating regularly. 

Additionally, the steps to avoid hypoglycemia include feeding the puppy a sugar supplement like Nutri-Cal, Nutri-Stat, karo syrup or processed honey to kick start a proper appetite. This is not a replacement for proper food, merely a way to provide the temporary energy needed to resume eating. This can be done by:

  • Putting the supplement on a finger to have the puppy lick it off 
  • Rubbing supplement on the puppy’s tongue, gums or roof of the mouth 
  • Ensuring the puppy swallows 
  • Supplement can also be administered by syringe, much like feeding a human baby. 

    As hypoglycemia is not considered an infectious issue nor hereditary or congenital in nature, cases of hypoglycemia are not covered by our Health Commitment. Ensuring a puppy eats properly and regularly is paramount to the ongoing health of a puppy and is solely the responsibility of the puppy’s owner.

How to File a Claim

What to do if your puppy gets sick:

  • Reach Out Right Away: If something seems wrong with your puppy's health, let us know soon as possible.
  • Get a Diagnosis: Visit your veterinarian and get an official diagnosis for your puppy. This diagnosis should be put in writing.
  • Send Medical Records: Send a copy of the medical records related to your puppy's condition to Mawoo Pets within five (5) business days of the diagnosis.
  • File Your Claim: You must submit your claim within 30 days of the original diagnosis date. Make sure to include all supporting documents or any other information that has been requested.

How we handle your claim:

  • Claim Review: After we've received all the necessary information, we'll evaluate your claim. The review process will be completed within 30 days of receiving all required information. We'll work together with your Breeder to see how the Health Guarantee can assist you and your puppy.
  • Second Opinion (if required): Sometimes, we might need to get a second opinion. This means we might ask another vet or a specialist to take a look at your puppy's diagnosis.
  • Reimbursement: If your claim is approved, any applicable reimbursement payments will be sent to your specific bank account via bank transfer within 14 days of a decision being reached.

Prescription Cost Guidelines

For certain ailments such as Giardia, Coccidia, coughs, and ear infections, we have set out the below guidelines on recommended treatment plans and costs that we will cover. Our priority is to ensure that your puppy gets the fastest and most effective treatment. There are instances where a combination of treatments is necessary, as one single prescription might not be enough to fully cure the ailment.

Reimbursement is only covered for one (1) incident per covered ailment per puppy. Reimbursement for these specific treatments is as follows:

  • Giardia: Treatment plan including both Fenbendazole and Metronidazole for a 5-day period is recommended. Ensure that you frequently bathe your puppy with warm, soapy water using dish soap to remove cysts and prevent further reinfection. Costs are covered up to $30.
  • Coccidia: A 5-day treatment with Sulfadiazine/Trimethoprim (Tribrissen) and Metronidazole is recommended. Again, regular bathing of your puppy using warm, soapy water and dish soap is important. Costs are covered up to $30.
  • Cough: Treated with Azithromycin for up to 10 days, and Baytril for 10 days is recommended. Costs are covered up to $30.
  • Ear Infection: Ear infections may be treated with Posatex Otic Suspension for up to 7 days. Costs are covered up to $35. 


Please note that these are common treatment prices. If you are charged more than these amounts, reimbursement will only be provided up to the rates listed.

Breach of Health Guarantee

This section outlines certain conditions and actions by the buyer that will constitute a breach of this contract and make this Health Guarantee null and void:

  • Buyer's Obligations: Failure to comply with any obligations stipulated in this contract on the part of the buyer.
  • Breeding Rights: Any violation regarding the breeding rights as stated in this agreement.
    Breeding Ability: Any misuse or misrepresentation of the puppy's breeding ability.
  • Veterinarian Mismanagement: If it is found that your veterinarian has mismanaged breed-specific vaccine protocols, leading to adverse health effects on your puppy.
  • Legal Action: If the buyer initiates legal action against the Breeder, Mawoo Pets LLC, or any of its properties.
  • Chargeback: Any chargeback post-delivery will be considered as fraud. If the buyer disputes a charge after the delivery of the puppy, they may face criminal prosecution or civil lawsuits.
  • Defamation, Libel, and/or Slander: Any defamatory, libelous, or slanderous actions or statements made by the buyer against the Breeder, Mawoo Pets LLC, or any of its properties.

Please understand that these conditions are serious and can result in the Health Guarantee becoming invalid, with no possibility of reinstatement.

Total Liability Limits

Impact of State Laws

The laws of your specific state may grant you additional rights beyond those detailed in this Health Guarantee. Please familiarize yourself with your local regulations to fully understand how they may impact your rights and obligations under this agreement.

Class Action Waiver

Agreement to Mandatory Individual Arbitration & Class Action Waiver


PLEASE READ CAREFULLY AS THIS AFFECTS YOUR RIGHTS. The buyer acknowledges and consents that any dispute, controversy or claim arising from or in connection with this agreement, or their interaction with or relationship with Mawoo Pets, will be resolved through binding arbitration administered by the American Arbitration Association on an individual basis. This process substitutes traditional court proceedings, and it is important to understand that there is no judge or jury in arbitration and that court review of an arbitration award is limited. By accepting these terms, the buyer is waiving the right to a trial by jury and to participate in any class action or other class proceeding.

The buyer further agrees to the following stipulations:

This agreement to arbitrate is intended to be interpreted broadly. It encompasses, but is not limited to: disputes and claims arising out of or relating to any aspect of the relationship between the buyer and Mawoo Pets, whether based in breach of contract, breach of any guarantees or warranties, tort, statute, fraud, misrepresentation, or any other legal theory. It also applies to claims that arose before this agreement or any prior agreement, claims that may arise after the termination of the buyer's relationship with Mawoo Pets, and claims that are currently the subject of purported class action litigation in which the buyer is not a member of a certified class.

The buyer agrees that the Federal Arbitration Act ("FAA") governs any arbitration and dictates whether a dispute is subject to arbitration. Unless the buyer and Mawoo Pets agree otherwise in writing, arbitration shall be administered by the American Arbitration Association ("AAA"), pursuant to the Consumer Arbitration Rules then in effect and conducted by a single arbitrator who is licensed to practice law.

THIS AGREEMENT DOES NOT ALLOW CLASS ARBITRATIONS. The buyer and Mawoo Pets are entitled to pursue arbitration only on an individual basis. The arbitrator may not consolidate more than one individual party's claims with any other party's claims or preside over any form of a representative or collective proceeding unless the buyer and Mawoo Pets agree otherwise in writing.

Each party is responsible for their respective costs related to counsel, experts, and witnesses. If judgment rules in favor of Mawoo Pets, the buyer agrees to pay the respective costs accrued by Mawoo Pets relating to court costs, counsel, experts, and witnesses.

This arbitration agreement does not prevent either party from bringing issues to the attention of federal, state, or local agencies, who can seek relief on a party's behalf if permitted by law. Additionally, either party may bring an individual action in small claims court.

If either party fails to comply with this arbitration provision, that party shall be liable for the costs and attorneys' fees incurred by the other party in enforcing compliance with the arbitration agreement.

All claims or counterclaims shall be resolved by the submission of documents only, unless a hearing is requested or the arbitrator decides a face-to-face hearing is necessary. Any hearing not held by telephone shall take place in the County in which Mawoo Pets operates, unless the arbitrator decides otherwise.

Small Claims Option: Buyers may also litigate any dispute in Small Claims Court in the County where Mawoo Pets operates if their claim meets all requirements to be heard in the small claims court. However, if the buyer initiates a Small Claims case, they are responsible for all their court costs.

Any proceeding to enforce this arbitration agreement, such as those to confirm, modify, or vacate an arbitration award, may be started in any court of competent jurisdiction. If this arbitration agreement is deemed unenforceable for any reason, any litigation against Mawoo Pets (except for small-claims court actions) may be started only in the federal or state courts located in the county where Mawoo Pets operates. You hereby irrevocably consent to the jurisdiction of those courts for such purposes.

Extended Agreement

This Health Guarantee constitutes the complete agreement about your pet's health between you, the buyer, and the Breeder, as well as Mawoo Pets. This Health Guarantee supersedes all other guarantees, extended guarantees offered independently by the Breeder, and any supplemental or conflicting terms and policies between the parties.
